Construction litigation has been a longstanding area of concentration for the firm. This area of practice includes representation of each type of contracting entity and has included contractual disputes, insurance coverage and tort. The experience of the attorneys has been as diverse as this industry. The areas of expertise include bad buildings, construction defects, construction means and methods, defense of architects, construction liens, and associated insurance disputes. This practice area has also included personal injury and property damage litigation.
Molzahn, Reed & Rouse has successfully tried several cases in this area including obtaining a defense verdict in a Wrongful Death Act and Survival Act case involving the death of a 3 year-old baby girl who fell off a three-story porch and died three hours after the incident. We represented the defendant contractor who built the stairway and had changed the original design of the side guardrail which created the opening through which the baby fell. We obtained another defense verdict on behalf of a general contractor in a construction site case where the plaintiff fell off a scaffold and shattered his wrist, requiring reconstruction with a four-pin device.
